In Massachusetts, if you are getting a divorce, you will have to go to court unless there’s a special waiver by the court.  That is typically not allowed, unless the party seeking the waiver is unable to attend because they live out of state, or extremely sick.  The judges know that no one wants to go to court, but in the state of Massachusetts you will have to go to court because the court must review the agreement.  The court will also want to question the parties as to whether there has been full and complete financial disclosure in the mediation process, and if the parties have signed the agreement freely and voluntarily.
