Massachusetts Divorce Attorney Explains the Mediated Divorce Process

I am often asked as a Massachusetts Divorce Attorney what the process of a mediated divorce is.  In Massachusetts the mediated divorce process involves meeting with a mediator, providing some general information that we would need to go over your case. We have both parties fill out a financial statement so that I am fully aware of what it is that comprises the marital state.  If they’re living together their expenses are obviously the same but in that case the assets in each party’s name might be different so it allows you to come to an understanding of an assets spreadsheet of what it is that the parties have to divide.

The exercise of filling out the financial statement is important because it’s not just for my purposes as a mediator, it’s for the court’s purposes. I advise clients as a Massachusetts Divorce Attorney that anyone getting divorced in Massachusetts has to file a financial statement.  I find that the work of doing a financial statement in the beginning can lay the groundwork for the course of the mediation and then be used as the financial statements that are entered as part of the divorce.
