Can I buy a house pre-divorce?  I have signed divorce papers but have not had a trial yet. I want to purchase a home but do not want my spouse to have any rights to it. Is the signed document enough to protect me (as a binding contract) or must we go thru trial before I close?

As an experienced Mansfield Divorce Attorney, I often handle legal matters like this.  If you purchased a home after signing your agreement but before your divorce hearing, you would need to amend your agreement to add your spouse’s release of the interest to the home. Keep in mind that nothing is “final’ until after the divorce has been approved by the judge and the requisite waiting period has expired.
