Massachusetts Divorce Attorney Discusses the Time Length of a Mediated Divorce

In Massachusetts a mediated divorce is generally quicker than a divorce that is not mediated, and that’s because the time it takes to get a divorce depends on how long it takes you to come to an agreement on all the terms. I advise clients as a Massachusetts Divorce Attorney that with mediation, once you have the agreement in principle and then it’s written down into a written agreement, you file it down with some other documents and you have a hearing and 120 days after that, the divorce is final. With a divorce that starts off as a contested divorce, you file a complaint for divorce and then there can be hearings on the amount of child support, the parenting schedule and so forth and the average track for a divorce in Massachusetts that is contested is 14 months.

However, as a Massachusetts Divorce Attorney I think there generally can be less time than that depending on court availability and how much progress is made during the intervening time to come to an agreement. Some cases do have to get litigated up to a pre-trial conference or to a trial but my goal always is to have the parties arrive to an agreement that they find satisfactory.
