The taxability of child support and alimony is really clear according to the IRS. Child support is not income the recipient spouse and it is not deductible by the payor spouse. The alimony, however, is deductible to the person paying and it’s income to the person receiving it. So sometimes in cases where people are making a significant income, we might allocate the tax issue and make them some of the payment child support and some of the payment alimony. In any case if it’s significant income that issue, the tax effect should absolutely be discussed.
