Bristol County Child Custody Attorney Discusses Relinquishing Your Parental Rights

Question:

I have two children with my ex and I am thinking of signing away my rights to my ex. Right now we currently have a standing order for shared custody but I am not able to provide for my children since I am not able to obtain employment in this country. I am on the deportation list. Would I still have to pay the back support for my children?  They are 7 and 8 years old.

Answer:

If the support accrued before you terminated your parental rights, you would still be liable for the child support. I have advised clients as a Bristol County Child Custody Attorney that it is possible that your former spouse could waive the right to collect the arrears.
