Child Custody

In Massachusetts, child custody takes two forms: legal custody and physical custody. Legal custody gives each parent the right to participate in decisions regarding the well-being of your child, including education, health care and religious training. In most cases, legal custody is shared by the parents, however, in some circumstances, legal custody may be given to only one parent. Physical custody means that the child's principal residence will be with you. In some cases, physical custody may be shared.

At our offices, we focus our efforts on ensuring that you get either sole or shared legal custody and sole or shared physical custody. We represent custodial and non-custodial parents in custody disputes. We also represent putative fathers and mothers in paternity actions (when the parents are not married) to determine custody rights.

Visitation

We will help you structure custody and visitation arrangements that are in the best interests of your children while protecting your rights as parents. You may also seek to have a non-scheduled visitation plan. A structured visitation plan includes a regular schedule, a holiday schedule and vacation schedule. We have also worked with grandparents who seek visitation.

Enforcement and Modification

If your circumstances have changed, you may be entitled to amend your custody or visitation order. For example, if you or your spouse has relocated or can no longer provide the care your child needs, we can help you file a complaint to request a modification of the divorce decree.

Similarly, if your ex-spouse has failed to comply with the divorce judgment, we can help you use the power of the court to enforce compliance, and we will seek an award of attorney fees for enforcement actions.
