Child Support

In Massachusetts, as in many states, child support is calculated using a formula found in the state's child support guidelines. The formula factors in the income of parents, the age of the children, the cost of daycare and cost of medical insurance for the family. We will review any proposed child support order to ensure that it complies with Massachusetts guidelines. We will also make certain that all relevant income is considered when making the calculation, including seasonal income, self-employment income and commission/bonus income. If there are legitimate reasons for you to deviate from the guidelines, we will act as your advocate to secure the necessary adjustments. We will also help you obtain a wage garnishment if you so desire.

Alimony or Spousal Support

A grant of alimony is not automatic in divorce proceedings in Massachusetts. Instead, the court will look at a variety of factors when determining whether alimony is appropriate, including the needs of the payee and the ability of the payor, the length of the marriage, the age and health of the parties, and the earning potential of both parties.

We will work closely with you, examining all the factors to determine whether a grant of alimony is warranted. If it is, we will help you determine the amount, frequency and duration of payments.

Modification and Enforcement of Existing Orders

If you have had a significant change in circumstances, such as an injury, illness or the loss of a job, you may be entitled to have your child support or alimony judgment changed. We will help you take the necessary steps to secure a modification. Likewise, if the other parent or your ex-spouse has failed to comply with the court's order regarding support, we can help you file a complaint for contempt and seek reimbursement, which could include your attorneys fees.
